Terms of Use

1. Acceptance of Terms

Access to and use of the KookiAI platform (hereinafter, “the Service”), operated by Jesús Rodríguez Canovaca, implies full and unreserved acceptance of these Terms of Use. If you do not agree with any of these terms, you must refrain from using the Service.

2. Description of the Service

KookiAI is an automated auditing platform that analyzes the behavior of cookies and tracking technologies on websites. Its reports are the result of an automated technical analysis and are merely informative and advisory in nature, and do not constitute legal advice.

3. Registration and User Account

To access the Service, the user must create an account by providing a valid email address and a password. The user is responsible for maintaining the confidentiality of their credentials and for all activities performed under their account. The user agrees to notify KookiAI of any unauthorized use of their account immediately.

4. Plans, Pricing, and Payments

KookiAI offers different subscription plans, with prices and features detailed on the pricing page. Payments are processed securely via Stripe. Charges will be applied according to the billing cycle of the contracted plan (monthly or annual).

Automatic renewal: Subscriptions renew automatically at the end of each period, unless the user cancels with sufficient advance notice through the billing portal.

Refunds: Given that the Service is digital in nature and is accessible immediately, the 14-day right of withdrawal for distance contracts does not apply, in accordance with Article 103(a) of the Spanish Royal Legislative Decree 1/2007. 5. Acceptable Use

The user agrees to use the Service lawfully and agrees not to:

  • Scan websites without authorization or for which they do not have the appropriate permissions.
  • Attempt to undermine the security, availability, or integrity of the platform.
  • Resell, sublicense, or commercialize access to the Service without express authorization.
  • Use the Service for fraudulent activities or activities that infringe upon the rights of third parties.

6. Intellectual Property

All intellectual property rights regarding the KookiAI platform, including its source code, visual design, brand, and content, are the property of Jesús Rodríguez Canovaca. The user does not acquire any ownership rights over the Service, but only a personal, non-exclusive, and non-transferable license to use it.

7. Service Availability

KookiAI will strive to keep the Service available on a continuous basis, but does not guarantee 100% availability. Interruptions may occur due to maintenance, updates, or force majeure events. The owner is not liable for any damages or losses arising from such interruptions.

8. Limitation of Liability

In any event, KookiAI’s liability shall be limited to the amount paid by the user in the 12 months preceding the claim. KookiAI shall not be liable for:

  • Direct, indirect, incidental, or consequential damages resulting from the use or inability to use the Service.
  • Legal sanctions or consequences derived from the interpretation of the reports generated.
  • Damages caused by third parties or by causes beyond KookiAI’s control.

9. Modification of Terms

KookiAI reserves the right to modify these Terms of Use at any time. Modifications will be communicated by publishing the new version on this page, indicating the date of the update. Continued use of the Service following the publication of changes constitutes acceptance of the new terms.

10. Applicable Law and Jurisdiction

These Terms of Use are governed by Spanish law. For any dispute arising from the use of the Service, the parties submit to the jurisdiction of the Courts and Tribunals of Spain.
